Texas Supreme Court Justice, Place 4 – Runoff Election Alert Alleged Arsonist vs. Confirmed Conservative In the runoff
elections today, those voting for the Republican race for the nomination for
Supreme Court Justice, Place 4, will effectively be electing
the next holder of that office since there will be no Democratic Party
opponent for that office in the fall.
For this reason, while we normally don’t endorse candidates, we do
think it is important that voters recall the suspicious nature of the
incumbent’s past legal entanglements.
Current Justice David Medina, initially appointed by Governor Perry,
and then subsequently elected to a full term in 2008, is running against
former district judge John Devine. On paper, Justice Medina makes for a better candidate for this important office. Unfortunately, the highly suspicious nature of a fire at his home, that also damaged neighboring homes, provoking an indictment that was then dismissed by the Harris County District Attorney (over the protests of the grand jury foreman and assistant foreman), make Medina a person of questionable character. The Republican D.A. that dismissed the case, Chuck Rosenthal, was himself later forced out of office in 2008 after emails exposing overt racism and abuses of power within his office were made public (a long overdue clean up of that office). The Republican Party establishment is strongly backing Medina. Yet, we can’t ignore the question of what happened that night in June 2008, the clouded nature of the investigation and case dismissal, and the strong hint of criminality and cronyism it all entails. John Devine is a hard-nosed, Tea Party conservative, which makes many uncomfortable; and he has been criticized for running his campaign as if he were running for a legislative office, and is probably not as accomplished or ideologically temperate as Medina. Devine is mostly known for having fought a successful legal battle to keep displaying the Ten Commandments in his courtroom, and is an unapologetic pro-lifer. These are the choices.
